Very comprehensive info- thank you for taking the time to write this up. Quick question: in the scenario where you have a 2nd mortgage, what's your advice for how to improve one's chances of getting the 2nd lien holder to approve the shortsale? The post here: http://www.shortsaleopedia.com/questions/9/if-i-have-multiple-liens-can-i-still-do-a-short-sale
indicated that they would be more likely to play ball since they get nothing in the event of foreclosure. I'm just wondering how that negotiation typically works from your experience and if there are things you recommend to improve one's negotiating position. thx

I would say contact an attorney, and it probably depends on state and local law. My guess is, it's probably not a good idea. Many have gone to jail for short sale fraud and I think this line is too blurred in an immediate family situation, but again I am not a lawyer so please do check with a professional!

What do you mean? A person in a property would typically need to be out by the closing date of the property, unless I misunderstand your question!

This is one of the most detailed short sale articles I have ever seen. It seems like you care about giving out the right information and I want to say thanks. The new legislation has made short sales more welcomed to homeowners.
